Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer", "you") and Ishaan Shringi, operating under the brand name FASSIX ("FASSIX", "we", "us", "our").
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Service Description
FASSIX is a software-as-a-service (SaaS) platform that allows you to create AI-powered characters (agents) for your website and WhatsApp. The Service includes:
- AI character creation and configuration (avatar, personality, expressions, knowledge base)
- An embeddable chat widget for your website
- WhatsApp integration (available on eligible plans)
- A dashboard for managing agents, monitoring conversations, viewing analytics, and managing contacts
- Real-time conversation inbox with human handoff capabilities
3. Account Registration
- You must provide accurate and complete information during registration.
- You must verify your email address before accessing the Service.
- You are responsible for maintaining the security of your account credentials. Do not share your password.
- You must be at least 18 years old to create an account.
- You are responsible for all activity that occurs under your account.
- You must notify us immediately at hello@fassix.com if you suspect unauthorized access to your account.
4. Free Trial
- New accounts receive a 7-day free trial on the Starter plan with full features.
- No credit card is required to start the trial.
- At the end of the trial period, your AI agents will go offline until you subscribe to a paid plan.
- We may send you a reminder email before your trial expires.
- The trial is limited to one per person or organization. Creating multiple accounts to obtain additional trial periods is a violation of these Terms.
5. Subscription and Payments
5.1 Plans and Pricing
- FASSIX offers multiple subscription tiers (Lite, Starter, Pro, Business) with different features and conversation limits.
- Current pricing is available at fassix.com/#pricing.
- Prices are listed in Indian Rupees (INR) and US Dollars (USD). The applicable currency is determined at the time of account creation.
- All prices are exclusive of applicable taxes unless stated otherwise.
5.2 Billing
- Subscriptions are billed monthly (30-day periods).
- Payments are processed through Razorpay. By making a payment, you also agree to Razorpay's Terms of Service.
- Each subscription period begins on the date of payment and runs for 30 days.
- An invoice is generated for every payment and can be downloaded from your dashboard.
5.3 Upgrades
- You may upgrade your plan at any time. Upgrades take effect immediately.
- When you upgrade, you pay the full price of the new plan and a new 30-day subscription period begins.
- Unused time on your previous plan is not prorated or refunded.
5.4 Conversation Limits
- Each plan includes a fixed number of conversations per billing period.
- A conversation is defined as a distinct interaction between a visitor and an AI agent, with a minimum gap of 30 minutes between conversations from the same visitor.
- When your conversation limit is reached, your AI agents will stop responding to new conversations until your next billing period or until you upgrade.
5.5 Refund Policy
All payments are non-refundable. Because we offer a free 7-day trial with full features, you have the opportunity to fully evaluate the Service before making any payment. Once a payment is processed, it cannot be reversed or refunded.
If you experience a technical issue that prevents you from using the Service, contact us at hello@fassix.com and we will work to resolve it.
5.6 Price Changes
We may change our pricing with at least 30 days' advance notice via email. Price changes will apply to your next billing period after the notice period. If you do not agree with the new pricing, you may cancel your subscription before the change takes effect.
6. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights
- Create AI agents that impersonate real individuals, government officials, or emergency services
- Generate, distribute, or facilitate illegal, harmful, abusive, harassing, defamatory, or discriminatory content
- Provide professional advice (medical, legal, financial, therapeutic) through AI agents without appropriate disclaimers and professional oversight
- Send unsolicited messages (spam) through WhatsApp or any other channel
- Attempt to bypass conversation limits, plan restrictions, or other usage controls
- Reverse-engineer, decompile, or attempt to extract the source code of the Service
- Interfere with or disrupt the Service, its servers, or connected networks
- Knowingly collect personal data from children under 18 without verifiable parental consent
- Use the Service for any purpose that competes directly with FASSIX
We reserve the right to suspend or terminate your account without notice if we determine, in our sole discretion, that you have violated this section.
7. AI-Generated Content
Important — please read carefully:
- AI responses are generated by artificial intelligence based on the knowledge base, instructions, and configuration you provide. They are not reviewed, verified, or endorsed by FASSIX.
- AI may occasionally produce responses that are inaccurate, incomplete, or inappropriate despite safeguards. This is a known limitation of all AI systems.
- FASSIX does not guarantee the accuracy, reliability, or suitability of AI-generated responses for any purpose.
- You are solely responsible for the content your AI agents produce, including any information, recommendations, or statements made to your visitors.
- You must regularly review and test your AI agents to ensure they behave as intended.
- You are responsible for having appropriate disclaimers on your own website informing your visitors that they are interacting with an AI.
8. Customer Responsibilities
As a customer deploying AI agents to interact with your visitors, you are responsible for:
- Privacy compliance: informing your visitors that they are interacting with an AI agent powered by FASSIX, and that their conversation data is processed by third-party AI services. You must update your own website's privacy policy accordingly.
- Content accuracy: ensuring the knowledge base, FAQs, and instructions you provide to your AI agent are accurate and up-to-date
- Monitoring: regularly reviewing conversations in your inbox to ensure your AI agent is performing correctly
- Compliance: ensuring your use of the Service complies with all laws and regulations applicable to your business and industry
- Data collection: if you configure data collection questions (name, email, phone), you are responsible for complying with applicable privacy laws regarding the collection of such data from your visitors
9. Intellectual Property
- FASSIX platform: all rights to the Service, including software, design, trademarks, and documentation, are owned by FASSIX. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service during your subscription.
- Your content: you retain ownership of all content you upload to the Service (knowledge base documents, FAQs, agent configurations, business information). You grant FASSIX a license to use this content solely for the purpose of providing the Service.
- Conversation data: conversations between your AI agents and your visitors are your data. We do not use your conversation data to train AI models or share it with other customers.
- Feedback: if you provide feedback or suggestions about the Service, we may use them without obligation to you.
10. Service Availability
- We strive to keep the Service available at all times but do not guarantee uninterrupted or error-free operation.
- The Service depends on third-party providers (OpenAI, AWS, Twilio, Razorpay). Outages or changes by these providers may affect the Service, and FASSIX is not liable for such disruptions.
- We may perform scheduled maintenance with reasonable advance notice when possible.
- We may modify, update, or discontinue features of the Service at any time. Material changes will be communicated via email or dashboard notification.
11. Limitation of Liability
To the maximum extent permitted by applicable law:
- FASSIX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill.
- FASSIX shall not be liable for any damages arising from (a) AI-generated content, (b) your reliance on the Service, (c) unauthorized access to your account due to your failure to secure your credentials, or (d) interruptions caused by third-party service providers.
- Our total aggregate liability for all claims arising from or related to the Service shall not exceed the total fees paid by you to FASSIX in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless FASSIX and its owner from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service or any content generated by your AI agents
- Your violation of these Terms or any applicable law
- Your violation of any third-party rights
- Any claim by a third party related to interactions with your AI agents
13. Termination
- By you: you may stop using the Service at any time. To request account deletion, contact us at hello@fassix.com.
- By FASSIX: we may suspend or terminate your account immediately and without notice if you violate these Terms, particularly the Acceptable Use section. For other reasons, we will provide 30 days' notice.
- Effect of termination: upon termination, your AI agents will immediately go offline. Your data will be available for export upon request for 30 days after termination. After 90 days, your personal data will be deleted in accordance with our Privacy Policy.
- Surviving provisions: Sections 7 (AI-Generated Content), 11 (Limitation of Liability), 12 (Indemnification), and 15 (Governing Law) survive termination.
14. Modifications to Terms
We may modify these Terms from time to time. If we make material changes, we will notify you by email at least 15 days before the changes take effect. The updated Terms will also be posted on this page with a revised "Last updated" date.
Continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service before the changes take effect.
15. Governing Law and Dispute Resolution
- These Terms are governed by and construed in accordance with the laws of India.
- Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Gujarat, India.
- Before initiating formal proceedings, both parties agree to attempt to resolve disputes amicably through good-faith negotiation for a period of at least 30 days.
16. General
- Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and FASSIX regarding the Service.
- Severability: if any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
- Waiver: failure to enforce any right or provision does not constitute a waiver of that right.
- Assignment: you may not assign your rights under these Terms without our prior written consent. We may assign our rights to a successor entity in the event of a merger, acquisition, or sale of assets.
